General Terms and Conditions – Casa Holiday Homes


1. Definitions

  • Lessor: Casa Holiday Homes
  • Accommodation: Casa Cranenweyer and Casa Anstelvallei
  • Guest: the natural person making the booking and acting as main booker
  • Agreement: the rental agreement between lessor and guest


2. Formation of the agreement

The agreement is concluded upon confirmed booking via the lessor’s website, Airbnb, Booking.com or any other booking channel used by the lessor.


3. Payment and security deposit

  • Payment shall be made using the payment methods offered at the time of booking.
  • A reservation is only final after receipt of the (down) payment.
  • If a security deposit applies, it will be charged in advance.
  • The lessor is entitled to offset the deposit against: contractually agreed penalties; provable and reasonably attributable damage; additional cleaning, repair or replacement costs; provable loss of revenue.
  • Any deduction will be itemised and substantiated.
  • Any remaining balance will be refunded within 14 days after departure.


4. Cancellation

  • Cancellation conditions apply as stated at the time of booking or on the booking platform used.
  • For direct bookings, the conditions stated in the booking confirmation apply.


5. Arrival and departure

  • Check-in: from 4:00 PM
  • Check-out: no later than 10:00 AM Deviations only with prior written consent.


6. Use of the accommodation and duty of care

  • The accommodation may only be used for recreational purposes.
  • The maximum number of permitted guests may not be exceeded.
  • The guest shall use the accommodation, inventory and installations with due care and in accordance with the principle of proper housekeeping.
  • House rules form an integral part of these terms.
  • Parties, nuisance and illegal activities are not permitted.


7. Inspection and reporting obligation

  • The guest shall inspect the ccommodation immediately upon arrival.
  • Any defects or damage must be reported within 24 hours after check-in.
  • Unreported defects are presumed to have arisen during the stay, unless the guest proves otherwise.


8. Identification and guest registration

  • The lessor is legally obliged to maintain a guest registration record.
  • The guest must provide accurate and complete details of all occupants, including: full name; date of birth; age (in years) of accompanying children; nationality; type and number of identification document (no citizen service number).
  • Data is processed in accordance with the GDPR.


9. Tourist tax

  • Tourist tax will be charged in accordance with the applicable municipal rates.
  • Exemptions are applied in accordance with local regulations.


10. Value Added Tax (VAT)

The lessor is legally required to charge Value Added Tax (VAT) on the rental of the accommodation. Unless expressly stated otherwise, all prices are inclusive of VAT. Changes in VAT legislation or rates may be passed on.


11. Electric vehicles and installations

  • Charging electric vehicles via sockets or electrical installations of the accommodation is not permitted, unless a designated charging facility provided by the lessor is used.
  • Upon detection, a directly payable contractual penalty of €250 per violation applies.
  • This penalty does not affect the right to claim provable and reasonably attributable damage, costs or consequential loss, nor the right to terminate the stay immediately if safety is at risk.


12. Smoking

  • Smoking is strictly prohibited throughout the entire accommodation, including cigarettes, cigars, pipes, e-cigarettes and other smoking or vaping products.
  • Upon detection, a directly payable contractual penalty of €250 applies.
  • In addition, the guest is liable for provable and reasonably attributable costs, including: additional cleaning and odour removal; damage to furnishings or inventory; provable loss of income or cancellation costs of subsequent guests, insofar as these are the direct and foreseeable result of the violation.
  • The lessor may terminate the stay immediately.


13. Liability

  • The guest is liable for damage to the accommodation, inventory and installations caused during the stay.
  • Damage must be reported without delay.
  • The lessor is not liable for loss, theft or injury unless caused by intent or gross negligence.


14. Force majeure

In case of force majeure (including natural disasters, government measures or failures beyond the lessor’s control), the agreement may be amended or terminated without entitlement to compensation.


15. Animals

The presence of animals of any kind is not permitted. In case of violation, the stay may be terminated immediately and provable costs may be charged.


16. Privacy

Personal data is processed in accordance with the privacy policy and the GDPR.


17. Governing law

These terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.
